Spraypaint Business Found Guilty Of Obstruction

fined £850 and each ordered to pay £352.59 costs under the Neighbourhoods and Environment Act 2005 Section 4 - Offence of carrying out restricted works (ie. repair and maintenance of vehicles) on a road.
The complaint came to the attention of Bury Council's Environmental Health Department when residents and neighbours of the Spraytech in St James Avenue Bury, complained about noise, odour and obstruction of the highway. The nuisance was caused by the defendants parking, repairing, jet washing and paint spraying cars in Back Byrom Street, Bury where they were also storing dismantled vehicles. Some residents found it difficult to walk along the street because of the activities of the defendant and one alleged damage to her wall from the jet spray.
Before the Clean Neighbourhoods and Environment Act 2005 was introduced there was no specific legislation to deal with these type of incidents which is why this case is the first of its kind in Bury although a caution was recently issued to a similar business in Bury East. Recent feedback from the residents in the Byrom Street area indicate that their environment has improved greatly since the council took action.
Councillor Michelle Wiseman Executive Member for Safe, Strong and Confident Communities said: "We want everyone living in our Borough to enjoy a safe, clean and green environment. BurySafe would like to warn businesses in similar types of business to only carry out works within the perimeter of their own premises - or else they will face prosecution".
